Diablo Mediation Services helps parties engaged in any dispute to resolve their differences through mediation.
What is Mediation? Mediation is an informal, voluntary process in which parties attempt to settle a dispute with the assistance of a neutral mediator. The mediator's role is to assist the parties in finding areas of agreement and a mutually acceptable solution. Throughout the process, the mediator assists each party in considering what are their most significant concerns, ways to accomplish their goals and the reality of what happens if a dispute does not resolve. If an agreement is reached, the mediator will help the parties document their agreement to finally resolve the dispute. If no agreement is reached, the parties remain free to pursue their legal remedies. How Can Diablo Mediation Services Help You? Mediation is useful to anyone engaged in a dispute. It allows each side to fully consider their goals, desires, potential gains and potential losses. It also allows the parties an opportunity to hear the other party's position, concerns and desires. Mediation also is valuable because it allows the parties to control the resolution of their dispute, and to craft individual, unique solutions. It also is far less expensive than litigation, or even arbitration of a dispute. Mediation also brings results faster than litigation. Mediation is often beneficial even when it does not result in a final settlement, because it can make the ongoing dispute less complicated and costly to resolve. For good reason, most real estate contracts require the parties to mediate before proceeding to arbitration or litigation. And of course, the best mediations result in win-win solutions.
